38wim Terms and Conditions – Platform Usage Rules

1. Definitions

For the purposes of these Terms, the following definitions apply:

• PlatformThe 38wim.best website and all online casino, Sports Betting, and digital entertainment services available on it.
• User / YouAny individual who accesses, registers for, or uses 38wim's services.
• AccountThe individual account created by the user to access 38wim's services, linked to a CPF and a personal, non-transferable access key.
• Real BalanceAmount deposited by the user, available for betting and withdrawals, in BRL (R$).
• Bonus BalancePromotional credit granted by 38wim, subject to rollover and any other conditions described in each promotion's specific terms.
• RolloverThe minimum wagering requirement on bonus funds before they can be withdrawn. Published with each promotional offer.
• PixBrazil's Central Bank instant payment system, used for deposits and withdrawals on 38wim.

2. Eligibility & Registration

To create an account at 38wim and use its services, you must meet all of the requirements below:

• Be at least 18 years of age at the time of registration.
• Be a Brazilian resident and hold a valid CPF.
• Not be subject to an active self-exclusion measure at 38wim or any other responsible gambling program.
• Not be an employee, service provider, or first-degree relative of a 38wim employee.
• Provide accurate, current, and complete information at the time of registration.

Each user may hold only an active account at 38wim. Creating multiple accounts, whether to claim repeated bonuses or for any other reason, violates these Terms and may result in the closure of all accounts involved and permanent suspension of access to the platform.

3. User Account

The account on 38wim is personal and non-transferable. You are solely responsible for keeping your access credentials — username and password — confidential, and for all activity carried out through your account.

38wim recommends that you:

• Use a strong, unique password for 38wim — different from any other platform.
• Enable two-step verification whenever it's available.
• Never share your login credentials with anyone.
• Notify 38wim support immediately if you suspect unauthorized access to your account.

38wim is not liable for losses resulting from the voluntary or involuntary sharing of credentials by the user. If unauthorized access is suspected, the account may be temporarily blocked to protect the user while the situation is investigated.

4. Deposits & Withdrawals

All amounts on 38wim are processed exclusively in Brazilian reais (R$). The platform does not operate in USD, EUR, or any other foreign currency.

Accepted deposit methods: Pix, bank slip (boleto), credit card, debit card, PicPay, Mercado Pago, and TED bank transfers through Brazil's major banks (Nubank, Itaú, Bradesco, Banco do Brasil, and others).

Withdrawals are processed to the same Pix key or bank account used for the deposit or previously registered on the user's account. 38wim may refuse or delay withdrawal processing in cases of suspected fraud, violation of these Terms, or pending identity verification.

Deposits made by bank slip (boleto bancário) may take up to 3 business days to clear. Credit or debit card deposits are credited within up to 30 minutes after confirmation from the card issuer. Via Pix, funds are credited to your 38wim account in seconds.

5. Bonuses & Promotions

The 38wim offers bonuses and promotions governed by specific terms published with each offer. The general rules that apply to all bonuses are as follows:

• Every bonus is subject to a rollover requirement (minimum wagering requirement) before it can be withdrawn. The exact rollover for each promotion is published on the offer page.
• The welcome bonus of 100% on the first deposit up to R$ 500.00 carries a 30× rollover on the bonus amount and must be met within 30 days.
• Each user is entitled to the welcome bonus once only. Attempting to claim the bonus multiple times through different accounts is a violation of these Terms.
• 38wim reserves the right to cancel granted bonuses if it detects a breach of eligibility conditions or misuse of promotions.
• Bonuses granted due to a technical error or platform mistake may be cancelled, with or without prior notice.
• Bonus balance cannot be withdrawn directly — only winnings generated after the bonus rollover is fully met are eligible for withdrawal.

6. Game Rules

All games available on the platform of 38wim — including slots, crash games (Aviator, Spaceman, JetX), Live Casino, roulette, blackjack, and Poker — are provided by certified suppliers and their outcomes are determined by random number generators (RNG) audited by independent entities.

The RTP (Return to Player) for each game is published on the game's page within the platform. 38wim does not alter game RTPs or interfere with round outcomes. Crash Games that use the Provably Fair system allow users to cryptographically verify the authenticity of each result after the round ends.

• Confirmed bets cannot be cancelled once the round has started.
• If a technical failure occurs during a round, the bet may be voided and the amount returned to the user's balance.
• 38wim is not liable for losses resulting from an unstable internet connection on the user's end during a game.
• Any attempt to exploit bugs, software errors, or system vulnerabilities for unfair advantage will result in immediate account termination and the freezing of any associated balances.

7. Sports Betting

The Sports Betting section of 38wim covers the Brasileirão Série A, the Copa do Brasil, the CONMEBOL Libertadores, the CONMEBOL Sul-Americana, the main state championships (Paulistão, Carioca, Mineiro, Gaúcho), and other sports such as volleyball, basketball (NBB), MMA/UFC, and e-sports.

• Live betting: available during live game broadcasts with odds updated in real time. 38wim reserves the right to suspend live markets at any time for technical or integrity reasons.
• Cash out: available on selected bets, allows the user to settle a bet before the final result. The cash out value offered is calculated based on current odds and may be lower than the original potential winnings.
• Accumulator bets: if an event within an accumulator is cancelled, the cancelled selection is removed and the accumulator odds are recalculated without that event.
• Official result: the result used for bet settlement is the score at the end of regular time (90 minutes in football), unless otherwise stated in the rules for that specific market.
• Obvious odds publishing errors may be corrected and affected bets may be voided, with stakes returned to the user's balance.

8. Prohibited Conduct

The following conduct is strictly prohibited on the 38wim:

• Creating more than one account for personal use or for the benefit of third parties.
• Providing false information, fraudulent documents, or third-party identities during registration or identity verification.
• Using bots, scripts, automated software, or any tool that simulates human activity on the platform.
• Exploiting bugs, technical errors, or system failures to gain an unfair advantage in games or withdrawals.
• Participating in any money laundering scheme or using the platform for unlawful purposes.
• Placing bets in collusion with other players to manipulate outcomes or improperly obtain bonuses.
• Using third-party payment methods — all deposits and withdrawals must be made using methods registered in the name of the account holder.
• Abusing promotions through practices known as bonus abuse, bonus arbitrage, or the systematic exploitation of promotional terms in a way that goes against the spirit of the offers.

38wim actively monitors accounts and transactions for patterns indicating the conduct described above. If such patterns are identified, the account may be suspended or closed, balances frozen, and the case referred to the relevant authorities where applicable.

9. Responsible Gambling

The 38wim believes that online entertainment should always be a free, informed choice made within healthy limits. That's why the platform offers real control tools that users can activate at any time:

• Deposit limit: set daily, weekly, or monthly deposit limits directly in your account settings.
• Temporary self-exclusion: 24-hour, 7-day, or 30-day breaks, applied immediately upon request.
• Permanent self-exclusion: permanent account closure at the user's request, with any new registration using the same CPF blocked.
• Reality check: periodic notifications about your active session time on the platform.

Use of 38wim's services is prohibited for anyone under 18, for individuals with an active self-exclusion measure, and for those in a demonstrable situation of financial vulnerability. 38wim may close accounts that show behavioral patterns associated with problem gambling, even without a request from the user.

10. Privacy and Data Protection (LGPD)

The 38wim processes its users' personal data in accordance with the General Personal Data Protection Law (Lei nº 13.709/2018 — LGPD). The data collected during registration and platform use is used exclusively for:

• User account creation and management.
• Processing deposits, withdrawals, and financial transactions.
• Identity verification (KYC) and fraud prevention.
• Account communications, promotions, and platform updates (with the option to unsubscribe at any time).
• Compliance with legal and regulatory obligations.

No personal data is sold or shared with third parties for commercial purposes without the explicit consent of the data subject. Users have the right to access, correct, transfer, or request deletion of their data at any time by contacting privacidade@38wim.best.

11. Limitation of Liability

The 38wim uses technology and processes to ensure platform availability and stability, but does not guarantee uninterrupted operation. The platform may be temporarily unavailable due to maintenance, updates, third-party technical failures, or events beyond 38wim's control.

38wim is not responsible for:

• Losses from bets or games resulting from the user's own decisions.
• Losses caused by an internet connection failure on the user's end.
• Unauthorized access to a user's account resulting from the user's own sharing of their credentials.
• Content from third-party websites that may be linked or referenced on the platform.
• Withdrawal delays caused by temporary unavailability of the Central Bank's Pix system or intermediary banks.

Under no circumstances shall 38wim's total liability to any individual user exceed the amount of deposited, unused real balance in that user's account at the date of the event giving rise to the claim.

12. Changes to Terms and Account Closure

The 38wim reserves the right to update these Terms at any time. Material changes will be communicated to users via their registered email or through a prominent notice on the platform at least 7 days before taking effect. Continued use of the platform after the notice period constitutes acceptance of the changes.

Users may close their account at any time by contacting 38wim support. The closure will be processed within up to 5 business days. The real balance available in the account at the time of closure will be returned to the user via Pix, after the required verification processes are completed.

38wim may close or suspend accounts in the following situations:

• Violation of any provision of these Terms.
• Request from competent Brazilian authorities.
• Extended inactivity (account with no activity for more than 12 consecutive months).
• Inability to verify the user's identity following a formal document request.

13. Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of the Federative Republic of Brazil, including the Consumer Protection Code (Law No. 8.078/1990), the General Data Protection Law (Law No. 13.709/2018), and applicable legislation governing the online entertainment and betting sector.

Any dispute arising from these Terms that cannot be resolved directly through 38wim shall be submitted to the jurisdiction of the courts of São Paulo/SP, with express waiver of any other jurisdiction, however privileged it may be.
